Full Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

Eligibility to enter / opening and closing dates

1. This prize promotion is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over excluding employees and their immediate families of The Promoter, The Data Controller, associated agents or anyone professionally connected with the prize promotion.

2. Entrants must be aged 18 or over.

3. This promotion opens at 00:01 on 17th August 2022 and closes at 23:59 on 6th September 2022. Any entry received after the closing date will not be valid. Proof of sending is not proof of receipt.

4. A maximum of 1 entry is permitted per person, per mobile number, per day and a maximum of one prize may be won per person. Anyone entering more than once using multiple handsets, multiple identities or computerised or automated system will be disqualified from the promotion.

How to enter

6. To enter this prize draw, text ‘GILBERT’ to 78866. Text messages will be charged at your standard network rate (they may not be included within any free text package). Please check with the bill payer before sending a text entry. Entrants are advised to take care when submitting an entry; the Promoter is not responsible for mistypes and incorrect texts may still be charged. Only correctly submitted entries will be accepted. For the avoidance of doubt, text entries featuring spelling mistakes will be disqualified. Capital or lowercase letters will both be accepted. Entries received after the closing date will not be entered but may still be charged.

7. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.

8. Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Selecting the winner(s)

9. 21 winners will be selected by a random draw via a computerised process on within 7 working days after competition closes from all valid entries received in accordance with these terms and conditions. Winner of main prize will be draw first, followed by runners up for prizes.

The Prize

10. Main prize: One winner will win the main prize, 2x 70cl bottles of The Famous Grouse, please drink responsibly and visit www.drinkaware.co.uk for more information; 1 Scottish Wildlife Trip (winner and one guest aged 18+, guest must also be 18+) including travel to and from hotel, either via train or flight; accommodation for 2 nights in a 4* hotel; half a day tour of the wildlife reserve with an experienced guide; lunch; and in the afternoon winners will be taken on a ‘behind the scenes’ experience from the Senior Site Manager to see areas of the reserve which are not open to the public. Winner will also receive a £150 meal allowance, in the form of a pre-paid card or voucher, to cover breakfast and evening meals. The winner and guest(s) are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize. Winners must book their trip with the RSPB by 30/01/2023, and trip must be taken in the during the month of May 2023 due to bird breeding reasons.

Runner up prizes: 20x RSPB memberships, in the form of a membership pack. Membership includes unlimited free entry into RSPB nature reserves across the UK*; a free gift, winners can choose from either the RSPB Handbook of British Birds or the RSPB Handbook of Garden Wildlife; delivery of Nature’s Home magazine, sent four time a year. *Visits to reserves are subject to local restrictions in different parts of the UK; membership are encouraged to check before visiting. Membership is for one adult, aged 18+ only and is valid for one year from activation date.  

11. 21 prizes in total. 

12. No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar, or part of a prize, prize of equal or greater value. The prize is non-transferable. If the winner of the main prize is not available to attend the trip during the month of May 2023 then a second prize draw will be done to select another winner.

Notification and delivery of the prize

13. The winners will be notified within 7 days of being selected, using the contact details provided on entry to this promotion. Winners of the main prize will be contacted directly on their mobile to organise the trip via phone call. The runner up winners will receive a text on the mobile number they have used to enter the promotion and will be asked to send an email stating the mobile number they used when entering to [email protected].

14. We reserve the right to verify winners and ask for proof of identity (passport, driving licence or equivalent), age and address. The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means.

15. The Promoter will make reasonable efforts to contact the winners. However, if a winner has not responded to first notification within 14 days, or if a selected winner is ineligible, rejects the prize, otherwise in breach of these terms and conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to select an alternative winner using the same process referred to above in these terms and conditions. The process will repeat for the main prize until an eligible winner is able to claim the prize. The process will repeat for three months for runner up prize winners after which all remaining prizes will be null and void. Entrants are encouraged to monitor their connections during this time in case they are a winner.

16. The winner of the main prize will be contacted by an RSPB representative to arrange their trip within 14 days after prize acceptance and the completion of any verification process;  and the runner up winners, once they have provided their email address and after the completion of any verification process, will be sent a membership form to the email they supplied. They are required to fill out the membership form and send it back to the email address on the form within 6 weeks of receiving it, in order to activate their membership. Details required on the membership form are: Full name, address, telephone number and email address. Once activated, winners will be sent a membership pack to the postal address provided on the membership form. Membership packs will be sent within 7 days of winner sending completed membership form. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of a prize.  The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

General

17. The winners are responsible for all expenses not expressly stated in these terms and conditions as being included as part of the prize.

18. If fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, any affected entrants will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion or prize.

19. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

20. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation. Data will be stored for three months after the close of the promotion then deleted with the exception of the main prize winner whose data will be deleted three months after the completion of their trip. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to [email protected]. By participating in the promotion, you agree to the use of your personal data as described here. 

21. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

22. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

23. The Promoter’s decision is binding in all matters relating to this promotion, and no correspondence shall be entered into.

24. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the fulfilment of the prizes and/ or the use of the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

25. The Promoter will make available the main prize winner’s surname and county of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting [email protected]. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winner’s details by emailing [email protected] .

26. Winners may be requested to take part in publicity relating to this promotion. If winners do not wish to take part, they must inform the Promoter when they are contacted by the Promoter and/or its agents to redeem their prize.

27. The Promoter’s decision is final and binding. No correspondence will be entered into.

28. These terms and conditions (and any non-contractual disputes/claims which arise out of or in connection with them) will be governed by English law and entrants submit to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the UK, in which case your local courts will have jurisdiction.
